Privacy Policy

1. Who we are

Kaapstad Connect PTY Ltd (“Kaapstad Connect”, “we”) is a digital marketing agency and website platform in Cape Town, South Africa. We are the responsible party under the Protection of Personal Information Act 4 of 2013 (POPIA) for the information described here. When we run marketing, websites or chatbots for clients, we handle their customers’ information on their behalf, and the client’s own privacy policy applies to it.

2. What we collect

Enquiries: name, email, phone, business name and your message. Website chat assistant: it answers in your browser from set information, so what you type is not sent to us; if you use its contact form, the details you enter are sent to us like any other enquiry. Website visits: IP address, device and pages viewed, through cookies only where you accept them. Listings and sign-up: business name, address, phone, email, services, images and any documents you upload. Payments: handled by PayFast; we do not store card details. Support: your requests and our replies. We do not ask for special personal information (such as health, religion or race) or for information about children.

3. Why we use it

To reply to enquiries and prepare proposals (steps you ask for before a contract); to provide services, invoice you and give support (our contract); to keep financial and tax records (legal duty); to improve our site and services (our legitimate interest); to send news and offers (your consent, or, for existing clients, our right to market similar services with an easy opt-out); and to protect our systems.

4. Listings and uploaded documents

Information you give us for a listing is published on your public listing page. Documents you upload are read by an AI service so we can build your site. Please do not upload ID numbers, bank details or other people’s personal information. Paid advertisement blocks on listing pages link to the advertisers’ own sites, which have their own policies.

5. Who we share it with

We do not sell personal information. We share it with service providers under written terms: our hosting provider, GitHub, Zoho, PayFast, an AI provider used under commercial terms that do not train on our content, analytics and advertising platforms, and our accountants and legal advisers. We may also share it where the law requires.

6. Transfers outside South Africa

Some providers process information outside South Africa. We transfer it only where POPIA allows: where the recipient is bound by law or a written agreement that gives similar protection, where you consent, or where it is needed to perform our contract with you.

7. How long we keep it

Enquiries that do not become clients: up to 24 months. Client and contract records: as long as the law requires, at least 5 years for financial records. Listings: while the listing is live, and removed within 30 days of a deletion request. Analytics: as set in the analytics tool.

8. How we protect it

Multi-factor sign-in, a password manager, encryption in transit, restricted access, monitored and backed-up systems, and confidentiality for everyone with access. If a security compromise affects your information, we will tell the Information Regulator and you as soon as reasonably possible.

9. Your rights

You may ask us to confirm whether we hold your information and give you a copy; to correct or delete it; to stop using it, including for marketing; and to say who we shared it with. Email info@kaapstadconnect.com. You may complain to the Information Regulator of South Africa at inforegulator.org.za. If you are in the EU or UK you may also have rights under the GDPR or UK GDPR.

11. Marketing

We send marketing only to people who agreed, or to existing clients about similar services. Every message shows how to opt out, and we do not buy contact lists.

12. Children

Our services are for businesses. We do not knowingly collect information from anyone under 18.

We may update this policy. The date above shows the latest version.
